Welcome to Himalayan Berry. These ‘’Terms of Service’’ (“Terms”) govern your use of our website, products, and services. By accessing or using any part of our website or placing an order with us, you agree to be bound by these Terms. If you do not agree to all the terms and conditions stated herein, you may not access the website or use any services.

Himalayan Berry operates the e-commerce website www.himalayanberry.in, through which we sell our proprietary prebiotic sparkling beverages. The business is legally registered in India and is governed by applicable Indian laws and regulations.

2. Eligibility
By using our services, you confirm that you are at least 18 years of age or are accessing the site under the supervision of a parent or legal guardian. You also agree that any personal information you provide to us is accurate and complete.

3. Products and Services
We strive to accurately display the descriptions, ingredients, pricing, and availability of all products listed. However, we do not guarantee that all information is error-free or current. Himalayan Berry reserves the right to correct any inaccuracies, change or update information, and refuse or cancel orders if any information is found to be inaccurate.
All products sold are intended for personal use only. Commercial resale is prohibited unless expressly authorised by us.

4. Orders and Payments
Orders placed on our website are subject to acceptance and availability. We reserve the right to reject or cancel any order due to inventory constraints, pricing errors, suspected fraudulent activity, or other legitimate business reasons.
All prices listed are in Indian Rupees (INR) and inclusive of applicable taxes unless otherwise stated. Payment can be made using the secure payment gateway options provided on the website. We do not store or process your payment card details directly.

5. Shipping and Delivery
Orders are typically processed within 1–2 business days and shipped via trusted delivery partners. Estimated delivery timelines for domestic orders are 3–7 business days, depending on your location. Delays may occur due to unforeseen circumstances such as natural disasters, strikes, or courier delays.
Currently, Himalayan Berry does not offer international shipping. All products listed are for delivery within India only.

6. Returns and Refunds
At Himalayan Berry, customer satisfaction is important to us. However, due to the consumable nature of our products, we follow a strict return and refund policy:

6.1 No Returns on Opened or Consumed Products
Once a can has been opened, used, or partially consumed, it is not eligible for return or refund. This policy is in place to protect all customers and ensure hygiene and safety standards.
6.2 Returns on Damaged or Defective Products
Returns are only accepted if the product is received in a visibly damaged or defective condition. Damaged products may include cans that are leaking, significantly dented, or have broken seals.
To request a return:
You must contact us within 24 hours of delivery.

Email contact@himalayanberry.in with your order number, clear photographs or video of the damaged item, and a brief explanation.

We will inspect the issue and, if your return is approved, you may receive a replacement or a full refund. Shipping charges are non-refundable.

7. Intellectual Property
All content on our website, including text, images, videos, logos, product designs, graphics, and trademarks, is the property of Himalayan Berry or its content suppliers and is protected by applicable intellectual property laws in India. Unauthorised use, duplication, or distribution of any material is strictly prohibited.

8. Prohibited Conduct
You agree not to:
Use our website or products for unlawful purposes;
Violate any applicable Indian laws or regulations;

Infringe upon or violate our intellectual property rights;

Transmit viruses, malware, or any code of a destructive nature;

Engage in fraudulent or misleading conduct.

Violation of these terms may result in suspension or permanent termination of your access to our services.

9. Limitation of Liability
To the fullest extent permitted by law, Himalayan Berry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue resulting from your use of our products or services. Our total liability shall not exceed the total purchase price of the product ordered.

10. Indemnification
You agree to indemnify, defend, and hold harmless Himalayan Berry, its directors, employees, agents, and affiliates, from any claim or demand made by any third party arising from your breach of these Terms or your violation of any law or rights of a third party.

11. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the court.

12. Modifications to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the website. It is your responsibility to review the Terms periodically. Continued use of the website after changes constitutes acceptance.

13. First Sip Guarantee

Eligibility

The First-Sip Guarantee is valid only on your first purchase from himalayanberry.in

Limit: One claim per household, per customer, per address.

Claim Process

If you wish to claim the guarantee, you must:

Inform us via email/WhatsApp within 24 hours of opening your first can.

Share your order ID and a photo of the opened can for verification.

Claims made after 24 hours of delivery will not be accepted.

Resolution

Eligible claims will receive a replacement pack or store credit of equal value.

Cash refunds are not provided.

Shipping costs (if any) are non-refundable.

Exclusions

Guarantee is not valid for:

Bulk/wholesale or repeat orders

Products bought via Amazon, Swiggy, Zomato, or other marketplaces (these follow their own policies)

Claims without proof (photo evidence + order ID)

Damage during delivery must be reported within 24 hours of receiving the order, with photos of the packaging and cans.

Abuse Prevention

We reserve the right to deny or block claims if we suspect fraud, abuse, or repeated misuse of the guarantee.

Any attempt to exploit the policy will result in being blacklisted from future orders.

General

All orders are subject to product availability.

Prices, offers, and guarantees may change at our discretion without prior notice.
